If the file is out, Peter is in the same boat as any other regenerator. They float or sink together, and other regenerators are proving buoyant.

I tell ya though... Claire is proving to be pretty freakin mentally resilient... If i woke up on an autopsy table and had to put myself back together, i think i'd go juuuuuuust a little nutsoid....

Mohinder tells Nathan in season one that his brother is dangerous because his DNA constantly re sequences itself to agree with the surroundings... then nathan says "like a chameleon" and then mohinder makes the sponge comment.

if sylar were to kill peter and take his ability he would get all the abilities he had absorbed... BUT he doesnt know everything he absorbed and would have a rather hard time trying to use an ability he has no idea of (just think if you had an ability and you didn't know about it, how would you know to activate it?)

so yes i do believe he would gain the abilities and i think sylar does also have the same type of situation... he too has his dna change but on a more mechanical level requiring that one person's DNA touches his own to re sequence... i.e. he may be a brain eater...
